UKCA Marking Certification is done as per Procedure / Scheme No. EVL/UKCA/PC-A/2021/C-1
To help The Organization stay on top of the changing compliance laws, here are some guidelines to help The Organization with the UKCA Marking.
The ‘UK Conformity Assessed’ also known as UKCA marking, will be the new product safety Certification marking by replacing the CE marking in the UK. On certain products in the context of Brexit, replaces the CE marking previously used in Great Britain (England, Scotland, and Wales) until December 31, 2021, for this region. Though CE Marking will continue to be accepted in Northern Ireland; substituting the EU requirements for CE Marking.
Products now will need to bear the UKCA marking, before being placed on the UK market to demonstrate product conformity with relevant UK legislation from 1 January 2021. As, the effect of the UKCA marking will not be immediate to go so the grace period will be given. Manufacturers of products, currently bearing the CE marking and placed on the UK market, will be allowed to continue to apply the marking to their products for a limited period prescribed. Such products would include the third-party assessment performed by an EU-recognised Notified Body. All other products decided to be marked under the new law, will have to be assessed the scope and nature of the product and affix with the UKCA marking. However, to give businesses time to adjust to all new rules and regulations, most products can be sold with CE marking until 1 January 2022.
This does not apply to existing stock, for example if The Organization good was fully manufactured, CE marked and ready to place on the market before 1 January 2021. In these cases, The Organization good can still be sold in Great Britain with a CE marking even if covered by a certificate of conformity issued by a UK body before 1 January 2021.
New requirements for product after last updates for UKCA Marking
As the decision was made in February 2020, that the United Kingdom was not part of EU nationals. This step was completed on January 1, 2021, with the consequence that the above-mentioned countries with their now remaining 27 member states will no longer be part of the European Union Nations.
This also has an impact on the approval of products (with radio technologies and other products). Within the scope and nature of the product, The Organization as the manufacturer are responsible for the:
• that The Organization product complies with the relevant UK regulations marking for England, Scotland and Wales or EU Directives
• as well as for the preparation of the documentation required for the fulfillment of the circulation, e.g. the declaration of conformity.

Technical Requirements for UKCA Marking
-The documentation and UKCA information can be requested at any time to check by market surveillance or enforcement authorities check that The Organization product conforms with the statutory requirements that The Organization product conforms with the statutory requirements.
-The Organization or The Organization authorized representative must keep documentation to demonstrate that The Organization product conforms with the regulatory requirements by keeping accurate and relevant records.
-Develop and design accurate processes and techniques for the manufacturing process.
-Establish and maintain documentation to demonstrate that The Organization product comply all regulatory requirements of UKCA Standard.
-Product has been passed all the relevant laws of the regulatory authority.'
-Fulfillment of the technical requirements and conformity assessment processes to complete conformity assessment.
-Submitting the Declaration of Conformity by
• the proper and accurate information about The Organization company name and full business address
• the product’s serial number and model type
• a statement, stating The Organization take full responsibility for the product default (in certain cases)
• the details of the assessment procedure
• the relevant legislation complies with the product

Does The Organization product require UKCA Marking?
Are The Organization manufacturing the products to market The Organization product to the UK? The UKCA marking applies to most of the goods and products previously subject to the CE marking and will be effective for all products placed on the GB. Newly it is also applicable o aerosol products that were previously under ‘reverse epsilon’ marking.

Special Case for Northern Ireland
The UKCA designation is not recognized in Northern Ireland; and will comply with the relevant EU rules for placing products on the market. UKCA marking cannot be used for goods and products placed on the Northern Ireland market. The United Kingdom, with much greater alignment with EU rules to prevent a 'hard border on the island of Ireland. Products that require CE marking for sale will continue to require CE marking in Northern Ireland. For market approval in Northern Ireland manufacturers may have to follow different requirements:
The Organization must use conformity marking on placing the product in the market.
-Like CE Marking, certain products are complying the wheel mark or the Pi mark.
-If The Organization use a UK body to perform mandatory third-party assessment The Organization must use UKNI.
As such, a variant of the UKCA mark must be used for goods to be sold in GB countries. UNKI looks very alike to the standard UKCA logo, but the last two letters is with 'NI' instead of 'CA'. The UKCA mark only applies to Great Britain (England, Scotland, Wales), and the CE mark or UK(NI) mark is a must for Northern Ireland and for areas where GB and EU rules remain the same.
The circumstances of self-declaration of conformity are the same as for CE marking and for UKNI marking for certain products such as Radio equipment - Directive 2014/53/EU in EU Nation and Radio Equipment Regulations 2017 in NI Legislation, Toy Safety - Directive 2009/48/EC with Toys (Safety) Regulations 2011.

Application of UKCA Marking
Before affixing the UKCA marking, The Organization take full responsibility for The Organization product’s conformity with the requirements of the relevant legislation directives stated by the law. Though the mark itself is not evidence of compliance with the Certification and standard implementation– The Organization technical documentation/technical file is. And The Organization must only use the UKCA marking without any other marking to avoid showing product conformity.
Rules need to follow while the application of the UKCA Marking
The Organization must make sure that The Organization product contain relevant marking by following the certain rules:
-UKCA labels may only be affixed by the manufacturer or authorized representative
-When The Organization affix the UKCA label, The Organization accept full responsibility for the relevant legislation of the standard to get the mark affixed.
-The UKCA marking must be easily visible, legible, and permanently attached.
-UKCA markings must only be placed on a product by The Organization as the manufacturer or The Organization authorised representative (where allowed for in the relevant legislation)
-when attaching the UKCA marking, The Organization take full responsibility for The Organization product’s conformity with the requirements of the relevant legislation
-The Organization must only use the UKCA marking to show product conformity with the relevant UK legislation
-The Organization must not place any marking or sign that may misconstrue the meaning or form of the UKCA marking to third parties
-The Organization must not attach other markings on the product which affect the visibility, legibility or meaning of the UKCA marking
-the UKCA marking cannot be placed on products unless there is a specific requirement to do so in the legislation

Differences between UKCA and CE marking
Many of the differences between the two marking systems are administrative. UKCA applies in the UK only. There are other differences relate to the separation of UK conformity assessment (UKCA) and CE Marking too. CE marking is a self-declaration from a manufacturer that proves compliance with health and safety following legislation and EU Directives and confirms a product’s compliance. In the same way, UKCA marking proves compliance with UK legislation and compliance with the regulation.

2.What conformity tests are commonly carried out for checking the product?
Common testing for compliance includes radiated emissions, conducted emissions, and telecommunications.
3.How does conformity testing take place?
EMC and RED (Radio Equipment Directive) testing is usually done at the end of product development to help The Organization save time and money during the compliance testing process.
4.What happens if a product is found to be unsafe?
If an enforcement body finds The Organization product to be unsafe, a chance will be given to rectify the problem. Failure to do so will take The Organization product off the market and liable for a fine.
5. Selling goods in the EU
The UKCA marking is not recognised on the EU market. Products need a CE marking for sale in the EU.
6. Rules for using the UKCA image
The Organization must make sure that:
• if you reduce or enlarge the size of your marking, the letters forming the UKCA marking must be in proportion to the version set out below
• the UKCA marking is at least 5mm in height for the whole logo, not individual letters – unless a different minimum dimension is specified in the relevant legislation
• the UKCA marking is easily visible, legible (from 1 January 2023 it must be permanently attached)

UK Declaration of Conformity
The UK Declaration of Conformity is a similar document like the EU Declaration of Conformity which must be drawn up for most products lawfully bearing a UKCA marking.
In the document you as the manufacturer, or your authorised representative (where allowed for in the relevant legislation), should:
• declare that the specific product is in conformity with the relevant statutory requirements applicable to the specific product
• make sure that the document has the name and address of the manufacturer (or your authorised representative) together with information about the product and the conformity assessment body (where relevant)
• your name and full business address or that of your authorised representative
• the product’s serial number, model or type identification
• a statement, stating you take full responsibility for the product’s compliance
• the details of the approved body which carried out the conformity assessment procedure (if applicable)
• the relevant legislation with which the product complies
• your name and signature
• the date the declaration was issued
• supplementary information (if applicable)
